KOTA BHARU, 24 Feb: Kelantan mungkin menjadi negeri pertama di negara ini yang menayangkan filem-filem secara percuma yang memberi mesej pengajaran dan dakwah kepada rakyat.

Timbalan Pengerusi Jawatankuasa Penerangan, Pembangunan Maklumat, Sains dan Teknologi negeri, Ahmad Baihaki Atiqullah berkata, perkara itu masih dalam kajian kerajaan sebelum ia dilaksanakan.

“Kita menjangka dapat menayangkan setiap dua hingga tiga bulan sekali filem-filem yang membawa mesej baik untuk rakyat.

“Apa yang penting filem yang ditayang itu tidak bercanggah dengan Enakmen Kawalan Hiburan 1998,” katanya.

Sebelum ini, kerajaan negeri pernah menayangkan filem dari Iran yang diarahkan Majid Majidi bertajuk Children Of Heaven.

Filem tersebut memenangi festival filem peringkat dunia yang memaparkan kisah menarik untuk tontotan masyarakat.

Pada 14 Februari lalu, filem Ketika Cinta Bertasbih yang diadaptasikan daripada novel Ustaz Habiburahman El-Shirazy juga dipertontonkan kepada orang ramai.

“Kami mendapat maklmum balas daripada orang ramai selepas tayangan pertama yang begitu positif sekali. Ini menyebabkan tayangan kedua diadakan,” ujar Ahmad Baihaki.

Beliau berkata, pihaknya sudah mendapat persetujuan dan kebenaran dari pengarah bersama filem itu, Habiburahman untuk menanyangkan filem terbabit.

Tayangan itu akan diadakan di Balai Islam, Lundang bermula jam 9 malam pada 28 Februari ini.

Keluhan Dr Abu Hassan Hasbullah mengenai Filem Islamik Di Pinggirkan Di Malaysia

1. Adakah benar rungutan dan tohmahan bahawa apa sahaja yang berhubungan dengan Islam seperti seni, sastera, budaya termasuk filem mendapat kesusahan yang teramat sangat untuk mendapat ruang di negara ini lantaran hujah-hujah yang mengaitkan "...apa sahaja yang Islami itu maka ia adalah gerakan tersurat dan tersirat menyokong PAS"?

2. Pandangan dan pertanyaan ini diterbitkan setelah dikhabarkan sekian banyak pertanyaan juga tentang filem Ketika Cinta Bertasbih (Chaerul Umam, 2009) dari teks Habiburrahman er-Shirazi dikatakan tidak beroleh izin tayang atas alasan kandungan Islami sebagai naskahnya.


Jika ya atau benar keadaan ini terjadi, ma
ka ia kemalangan yang amat besar buat umat Islam di negara ini khususnya dalam asa untuk memajukan pemikiran, filsafat, dan pengetahuan Islam secara konstruktif

Seni, sastera, budaya dan media Islami adalah prakarsa terbaik dalam mengadiluhung peradaban bangsa agar segala kepunahan sekarang yang terjadi, dengan segala macam tunasosial dan tunamoral di kalangan ahli mas
yarakat, setidaknya dapat dipulihkan dengan kemujaraban Islam sebagai ad-deen.

3. Sebab itu ramai yang bertanya, betulkah semua drama di RTM dan TV3, termasuk di media lain sama sekali tidak boleh memak
ai KUPIAH, SERBAN, atau JUBAH... yang dibenarkan cuma songkok dan baju Melayu sahaja?

Apakah masyarakat di Malaysia yang memakai kupiah atau serban semuanya PAS?

Sesiapa yang mempunyai data tentang hal ehwal ini sila berikan di sini atau terus ke FB Zentrum kerana rasanya perlu ada satu geraka
n untuk menyelesaikan krisis tamadun ini.

4. Saya dikhabarkan sendiri oleh Akhi Habiburrahman er-Shirazi, pengarang Ketika Cinta Bertasbih, selaku pendokong malah turut berlakon dalam filem KETIKA CINTA BERTASBIH yang permohonan untuk tayangan telah dibuat secara serentak dengan jadual di Indonesia, Brunei, Australia, Thailand, termasuk beberapa negara di Eropah, dan satu sahaja yang tidak mendapat izin iaitu Malaysia.

Wah apakah yang sebenarnya telah terjadi?

Adakah juga nanti semua imej atau visual, atau "shot" masjid juga akan diharamkan secara surat arahan sekira drama atau filem tempatan mahu mendapat izin tayang di TV atau Pawagam?

Rakyat berhak untuk mendapat penjelasan kerana kenapa semua bising bila Pulau Pinang membatalkan perarakan maulud, dan kenapa pula semua tidak bising bila "kupiah", "serban", dan lain-lain imej Islami tidak dibenarkan dalam drama-drama TV dan filem kita?



Komen Habiburrahman el-Shirazy Mengenai Kelantan


Siang itu,14hb. Februari, 2010, saya mendarat di Bandara Kota Bharu, Negeri Kelantan. Saya datang ke Kelantan atas undangan Departemen Penerangan Kerajaan Negeri Kelantan, sebagai pembicara ahli dalam acara talkshow berjudul, Selebriti Sebagai Ikon Masyarakat dalam momen Festival Hiburan Islami.

Juga diundang untuk memberi kuliah umum di Masjid Kerajaan. Tiba di bandara panitia sudah datang menjemput. Mereka terdiri dua orang gadis dan dua orang lelaki. Ramah dan baik. Saya langsung diajak untuk menemui tokoh paling dihormati di Negeri Kelantan, yaitu seorang ulama kharismatik yang juga menjabat sebagai Menteri Besar Kerajaan Negeri Kelantan, yaitu Tuan Guru Dato’ Haji Nik Abdul Aziz Bin Nik Mat.

Di rumah dinas, tempat Menteri Besar biasa menerima tamu, para wartawan dari media cetak dan elektonik telah menunggu.Ternyata di sana sudah datang terlebih dahulu seorang artis dan penyanyi terkemuka Malaysia yang kini setia mengenalkan jilbab, yaitu Wardina Shafiyyah. Tuan Guru Nik Abdul Aziz menyambut dengan senyum yang mengembang.

Kharismanya sebagai seorang ulama tampak jelas. Sayangnya beliau tidak bisa berlama-lama menemani. Sebab saya datang memang terlambat. Saya sampai di Kota Bharu pukul 12 siang lebih, yang semestinya dijadwalkan pukul 11 siang. Penyebab keterlambatan itu adalah pesawat Malaysian Air Lines yang tidak tepat waktu. Semestinya terbang dari KLIA ke Kota Bharu pukul 10.00 ternyata baru terbang pukul 11.20. Saya dijadwalkan bertemu dan berbincang dengan Menteri Besar Tuan Guru Nik Abdul Aziz pukul 11.00, dan beliau ternyata sudah menunggu sejak pukul sebelas.

Beliau pun masih setia menunggu sampai saya datang. Hanya saja tidak bisa berlama-lama menemani, sebab ada tamu lain yang juga harus beliau temui. Sementara beliau menemui tamu yang lain, saya yang baru datang diminta untuk menyantap hidangan makan siang bersama Wardina Shafiyyah dan suaminya. Sebelum makan siang, para wartawan minta konferensi pers. Banyak pertanyaan yang diajukan seputar perkembangan perfilman di Indonesia.

Ada juga yang bertanya tentang proses pembuatan film berkarakter seperti Ketika Cinta Bertasbih dan Ayat Ayat Cinta. Saya sempat menunggu-nunggu adakah wartawan yang akan menanyakan hal berkaitan dengan Manohara. Sebab saya sedang berada di tempat Manohara pernah membuat kisah yang banyak mendapat perhatian di Indonesia. Ternyata tidak ada satu pun yang menyinggung masalah itu. Semuanya fokus menanyakan segala hal yang berkaitan dengan seluk beluk perfilman dan sastra.

Adzan dhuhur berkumandang, Menteri Besar mengajak shalat berjamaah. Saya tidak ikut karena ada bagian dari pakaian saya yang kotor, saya memilih untuk menjama’ shalat dengan jama’ ta`khir. Selesai shalat berjamaah Menteri Besar kembali menemui saya. Kami berbincang- bincang sebentar. Lalu bagian dokumentasi Kerajaan Negeri Kelantan meminta saya berfoto bersama Menteri Besar Tuan Guru Nik Abdul Aziz.

Setelah itu panitia mengajak saya langsung ke acara inti yaitu talk show di KB Mall Kota Bharu Kelantan. Panitia memberi tahu pengunjung telah membludak. Saya meminta pengertian panitia untuk membawa saya ke hotel dulu. Sebab saya baru tiba dari bandara, saya perlu cuci muka dang anti pakaian.

Sebenarnya sejak awal saya ingin ke hotel dulu dan berpakaian lebih rapi ketika bertemu dengan Tuan Guru Nik Abdul Aziz. Tetapi waktu tidak memungkinkan, Tuan Guru sudah lama menunggu. Akhirnya saya ikut saja. Maka ketika saya diajak langsung ke KB Mall, saya minta pengertian panitia. Dan mereka setuju. Saya dibawa ke Kelantan Trade Centre untuk membersihkan badan dan ganti pakaian. Acara talk show di KB Mall berjalan hangat. Pengunjung membludak.

Yang unik adalah background panggung dan hiasan Mall seratus persen bernuansa China. Karena hari itu memang bertepatan tahun baru China. Akan tetapi acara sesungguhnya adalah Festival Hari Hiburan Islam. Dalam acara itu tampak jelas kerinduan masyarakat Malaysia akan hadirnya film-film Islami di Malaysia. Masyarakat Malaysia mengakui dalam hal kreatifitas pembuatan film Islami pun Malaysia masih tertinggal beberapa langkah dari Indonesia.

Mereka takjub dengan yang terjadi di Indonesia.Mereka merindukan adanya audisi pemilihan bintang film yang bermoral seperti yang dilakukan di Indonesia melalui film Ketika Cinta Bertasbih. Hari berikutnya, saya menyempatkan diri melihat rumah kediaman Menteri Besar sederhana dan paling bersih di Malaysia. Saya memang ingin melihat langsung seperti apa rumah tokoh besar yang namanya tercatat dalam 50 tokoh Islam berpengaruh didunia dan dimuat dalam buku berjudul ”The 500 Most Influential Muslims” yang dieditori oleh Prof. John L Esposito dan Prof Ibrahim Kalin.

Rumah Menteri Besar Nik Abdul Aziz memang biasa saja, sama dengan umumnya rakyat Malaysia. Rumah itu ada di samping masjid, berada di komplek lembaga pendidikan yang didirikannya. Tak ada penjaga. Tak ada protokoler. Tak ada polisi yang tampak. Benar-benar biasa.

Siapa pun bisa menemui Menteri BEsar ini jika beliau ada di rumah. Siang itu beliau tidak ada di rumah. Saya memang tidak membuat janji untuk itu. Saya ditemui salah satu putra beliau yang juga bersahaja. Dari cerita orang-orang Kelantan, ternyata Menteri Besar Dato` Nik Abdul Aziz dikenal orang yang sangat dekat dengan segala lapisan masyarakat. Ada kebiasaan unik yang dilakukan pemimpin paling kharismatik di Malaysia ini.

Setiap hari Jumàt, tepatnya setelah shalat shubuh, Menteri Besar yang juga ulama besar ini selalu menyediakan diri menjadi tukang cukur bagi rakyatnya. Maka tak heran, jika setiap hari Jumàt, masyarakat berdatangan shalat shubuh di masjid beliau, dan beliau yang menjadi imam shalat. Selesai shalat shubuh puluhan orang bersiap diri untuk dicukur rambutnya oleh beliau. Dan beliau melakukan hal itu dengan penuh rasa sayang pada rakyatnya.

Kebiasaan beliau yang lain. Selama ada di kantornya,jika bukan untuk urusan Negara maka beliau akan mematikan semua fasilitas yang ada di sana. Misalnya jika dia harus shalat pada waktu malam, karena shalat adalah urusan pribadi dan bukan urusan Negara, dia mematikan lampu dan AC yang ada di ruangannya. Kepribadian ini mengingatkan pada kepribadian Umar bin Abdul Aziz.

Tak heran jika Dato` Nik Abdul Aziz ini,pada tahun 1998 dinobatkan oleh Gerakan Rakyat Anti Korupsi (GERAK) sebagai Menteri Besar - kalau di Indonesia sepadan dengan gubernur - yang memiliki reputasi paling bersih di Malaysia. Anugerah itu diberikan sebagai penghargaan atas usaha beliau menentang gejala bentuk suap dan korupsi selama memerintah Negeri Kelantan selama hampir 18 tahun.

Tiga hari saya berada di Malaysia, dan saya menjumpai betapa cintanya penduduk Kelantan pada Tuan Guru mereka, kepada ulama mereka yang juga menjadi Menteri Besar mereka. Ada kalimat Tuan Guru Dato` Haji Nik Abdul Aziz yang diingat selalu oleh rakyatnya, yaitu, ”Pemimpin yang baik adalah pemimpin yang mampu menyatukan hati banyak orang. Bukan pemimpin yang hanya mampu menggunakan kekuasaannya untuk membatasi ini dan itu.”

Selama tiga hari juga,saya masih penasaran kenapa tidak satu orang pun yang menyinggung Manohara. Akhirnya pada suatu jamuan makan bersama beberapa panita, salah seorang dari mereka menanyakan kasus Manohara. Dia bertanya, apakah citra Kelantan sedemikian buruk di Indonesia. Saya jawab,mungkin iya. Tampak dia agak sedih.

Saya lalu balik bertanya sebenarnya bagaimana masyarakat Kelantan memandang kasus Manohara? Orang itu menjawab, mayoritas masyakarat Kelantan tidak tahu menahu tentang kasus Manohara. Tidak ada beritanya sama sekali di Kelantan. Dan itu juga bukan urusan pihak Kerajaan Negeri Kelantan, tetapi itu urusan dalam rumah tangga Istana Raja. Dia sendiri memandang tidak ada yang bisa dibenarkan dalam kasus Manohara. Menurut dia kedua-duanya salah. Dia berkata, ”Mereka bertemu secara tidak baik-baik, dan berpisah juga dengan tidak baik-baik.

Itu masalah dua anak kecil yang tidak baik, tetapi disangkut-pautkan dengan negara.’ Paling tidak mendengar hal itu, saya telah mengetahui satu sudut pandang masyarakat Kelantan tentang kasus itu. Kenyataan yang saya temui, masyarakat awam Melayu Kelantan sangat menghargai bangsa Indonesia. Dan masih mengakui Indonesia sebagai bangsa besar.

Seorang di antara mereka dengan jujur mengatakan kepada saya, ”Indonesia adalah ikon Islam di Asia Tenggara. Jika Indonesia tegak, maka umat Islam di Asia Tenggara termasuk Malaysia tegak. Jika Indonesia runtuh yang lain juga akan runtuh.”

Sambutan Tahun Baru Cina Yang Menghairankan..




Hairan..hormat dan kagum..itulah ungkapan yang saya boleh berikan kepada pimpinan masyarakat Cina di NS yang mewakili Dewan Perhimpunan Cina N.Sembilan. Mereka menjemput kami ke Majlis Sambutan Tahun Baru Cina yang mereka adakan pada 15hb Feb yang lalu. Layanan mereka sama seperti layanan yang mereka berikan kepada YAB Menteri Besar N.Sembilan. Ini berbeza dengan pimpinan NGO Melayu yang melayan pimpinan Pakatan Rakyat seperti pimpinan kelas kedua. Ketakutan dan kebimbangan menghantui mereka seolah-olah mereka yakin bahawa UMNO dan BN sahajalah yang boleh memberi apa yang mereka mahukan. Saya tidak salahkan mereka kerana inilah tahap politik orang Melayu. Yang menariknya di akhir majlis tersebut, YAB MB memberikan derma berjumlah RM100,000 kepada Sek Tinggi Chung Hwa dan RM50,000 kepada Dewan Perhimpunan Cina NS. Bagaimana SRIAS , SRI Abim dan Sekolah Agama Rakyat, sudah dapatkah bantuan dari pejabat MB N.Sembilan.

ADUN sokong kayuhan solo Zainuddin

SEREMBAN – Semangat dan kesungguhan Zainuddin Haron, 50, yang tekad membuat kayuhan berbasikal secara solo bertemakan 1Malaysia dijangka akan dimulakan pada 13 Februari ini mendapat perhatian Ahli Dewan Undangan Negeri (ADUN) Paroi, Mohd Taufek Abd Ghani.


Sebagai menghargai kesungguhan Zainuddin itu, beliau menerusi Pusat Khidmat Masyarakat Dewan Undangan Negeri (DUN) Paroi menyumbang wang tunai dan bendera Negeri Sembilan serta mendapat kerjasama daripada HPA Industri yang menaja air sepanjang perjalanannya ke seluruh Malaysia.

Taufek berkata, usaha dilakukan Zainuddin yang mahu mengharumkan nama negeri ini wajar diberi sokongan dan dicontohi terutamanya generasi muda.

“Saya terbaca dalam Sinar Harian dan tertarik dengan daya usaha yang cuba dilakukannya yang mahu mencipta sejarah tersendiri membuat kayuhan 1Malaysia.

“Malah, saya turut berbangga apabila penduduk Paroi sendiri tampil berani melakukan sesuatu yang bakal membuatkan seluruh masyarakat di negeri ini kagum,” katanya.

Menurutnya, dalam usia yang sudah mencecah ke 50-an, semangat berkobar-kobar ditonjolkan lelaki itu wajar dipuji selain menjadikan contoh kepada masyarakat bahawa aktiviti bersukan ternyata menyihatkan badan.

“Sebagai tanda sokongan, saya akan menghubungi empat buah negeri iaitu Kelantan, Pulau Pinang, Selangor dan Kedah untuk menyambut Zainuddin dan meraikannya apabila diasampai ke negeri terbabit,” katanya.

Anwar-The Victim of Overzealous Prosecution

I have been practising as a criminal lawyer for almost 16 years. I have considerable experience defending accused persons who were being charged for sexual related crimes. My experience tells me that the prosecution will never charge a person for an offence of rape or sodomy if the medical evidence is not favourable to them. It is almost an accepted rule of practice or a legal norm, as far as the offence of rape or sodomy is concerned, medical evidence operates as oxygen to the prosecution.

It seems to me that such a practice is no longer adhered to in the current ongoing trial of Anwar Ibrahim. When the accused person is Anwar Ibrahim the rule of game is suddenly and drastically changed. When Anwar is charged the prosecution no longer seems to gauge the strengths of its case on the available evidence they have. When Anwar Ibrahim is tried the prosecution will, come what may, happily proceed with the trial regardless whether it has fragile evidence or no evidence at all against him !!

The only crime Anwar committed in this case is for having the name, Anwar Ibrahim.

I believe that if another person by the name of Ibrahim Anwar or any other Ibrahims allegedly sodomised Saiful the prosecution would not charge such a person when provided with the medical report prepared by doctors in Pusat Rawatan Islam ( Pusrawi ) and Kuala Lumpur General Hospital respectively.

Both reports, as I was told by lawyers in Anwar’s legal team, contain a very damning evidence against the prosecution in that they unequivocally state that there are no visible signs of penetration of Saiful’s anus. As far as the report of the Kuala Lumpur General Hospital is concerned, it was duly signed by three doctors. So what the prosecution have in their possession are the reports certified by four doctors ( one from Pusrawi and three from KLGH ) apparently dismissing the prosecution’s theory that Saiful was ever sodomised by Anwar.

People may ask why the AG, despite such a damning evidence against the prosecution, is still adamant, and not withdraw the charge against Anwar?The reason is pretty obvious, that is the accused person is Anwar Ibrahim. When Anwar Ibrahim is tried the prosecution will not care even with the existence of a hundred medical reports exonerating Anwar Ibrahim of any sexual offence.

To the layman, this question may crop in their mind. Is the medical evidence really significant in Anwar’s trial ? The answer to that is a resounding yes. As I have indicated earlier the medical evidence is oxygen to the prosecution’s case. The prosecution case dies the moment oxygen disappears or malfunctions.

It is a rule of prudence, as the lawyers call it, in any sexual related crimes, the evidence of the complainant per se is legally insufficient . Such evidence must be corroborated by other independent evidence.

Translated into Anwar’s trial, Saiful’s evidence alone is not sufficient to convict Anwar. His evidence must be corroborated. Of course a corroboration is not needed for all crimes. But in sexual offences, corroboration is highly significant in order to support the factum ( act ) of the alleged sodomy.

Why corroborative evidence is necessary in sexual related cases ? The legal practitioners say such evidence is needed because of the nature of such offences. In any rape or sodomy case it is relatively easy to allege that a crime has been committed by such and such person but it is on the other hand difficult for any person who is being charged to such offences to disprove such an allegation.

We can see clearly even before the court passes any verdict on Anwar, judging from the media coverage which appeared in Utusan and other BN’s controlled media, Anwar is as good as being found “guilty” by these so called juries. The media coverage was so vicious that one wonders whether Anwar’s, or for that matter, his family’s dignity brings any value to this irresponsible media.

The law says if you accuse somebody of committing a sodomy against you the law requires you to furnish corroborative evidence to support your allegation. That is why even in Islamic criminal law if a person is charged for sodomy, the prosecution must bring four witnesses who really see the actual penetration. That shows Islam also takes into account corroborative evidence.

And in Islam the standard of proof in sodomy case is very high indeed that is the prosecution must prove its case beyond any shadow of doubt, and the present standard of proof in civil law which is only beyond reasonable doubt. Thus in Islam any iota of doubt must be ruled in favour of the accused based on the maxim that “ the offence of hudud is withdrawn whenever iota of doubt is present ” . Islam holds the view that it is much wiser for a judge to err in acquitting 10 guilty persons rather than to err in convicting even one innocent person !!

In sodomy , like a crime of rape, the essential element which needs to be proven by the prosecution is the act of penetration itself. In Islamic law the same element also needs to be established by the prosecution in certainty.

Now how is the prosecution able to prove the element of penetration if they do not produce the medical reports/evidence? And how are the medical reports in Anwar’s trial useful to prosecution if they clearly say no visible signs of penetration to Saiful’s anus. The medical evidence is supposed to corroborate Saiful’s evidence but apparently in this case the same medical reports in fact exonerate Anwar Ibrahim. The rule is so simple : no penetration no prosecution. But the AG seems to hold the view that yes, no penetration but mind you we still have persecution to do!!

It is beyond question if Anwar is tried under the Islamic law, the charge, as it is presently framed against him, will never see the light of the day. Seeing the oral testimony of Saiful so far one cannot avoid to jump to the conclusion that it was a groundless or trumped up charge.

The AG should exhibit a high level of professionalism and integrity in the Anwar’s case. Intellectual honesty dictates that the prosecution should withdraw the charge against Anwar Ibrahim. Period. To prosecute a person in the absence of credible evidence is definitely tantamount to a prosecutorial misconduct and wastage of public funds.

The day that AG becomes the tool of the crooked politicians should have passed after the election tsunami in 2008.

Australian lawmakers say drop sodomy case

More than 50 Australian lawmakers have lodged a formal protest urging Malaysia to drop opposition leader Anwar Ibrahim's sodomy trial and warning it will hurt the country's image, an official said today.

The group, which includes MPs and senators from both major parties, called for the case against Anwar to be abandoned in the interests of building "confidence in the impartial rule of law in Malaysia".

"Many friendly observers of Malaysia find it difficult to believe that a leading opposition voice could be charged with sodomy a second time, and so soon after his party made major gains in national elections," the protest letter says.

"It should be made known to the Malaysian government, that in our opinion, global esteem for Malaysia will be affected by these charges against Mr Anwar.

"We hope that Malaysia's authorities will not pursue these charges."

Michael Danby, member of the governing centre-left Labor party and chairman of Australia's foreign affairs parliamentary subcommittee, said he handed the letter to Malaysian High Commissioner Salman bin L Ahmad in Canberra yesterday.

Support for fellow democrat

"We (feel we) should stand up and support a fellow democrat."

Former opposition leader Malcolm Turnbull and Bob Brown, leader of the Greens Party were among the signatories, as well as independent Senator Nick Xenophon and two minor members of the Labor Party frontbench.

Danby said the Malaysian High Commissioner was well aware that there was a "wide spectrum of opinion in Australia" and the letter was not intended to inflame diplomatic relations.

"We hope it shows people in Malaysia and the opposition that we care," said Danby.

Anwar, who faces 20 years imprisonment if convicted of illicit sexual relations with a young former aide, has condemned the allegations against him as a political conspiracy to sideline the opposition.

He has accused High Court judge Mohamad Zabidin Diah of refusing to rein in "biased" media coverage of the much-delayed trial, which began last week.

Anwar was arrested in 1998 on sodomy and corruption charges but made a stunning comeback after being freed from prison in 2004. His sexual misconduct charge was overturned after six years behind bars.

What's wrong with Malaysia

MARK COLVIN: More than 50 Australian federal MPs have signed a letter to the Malaysian Government protesting against the trial of the former deputy prime minister Anwar Ibrahim.

It's the second time Anwar has been brought to court charged with sodomy, a fact that the letter describes as hard to believe for many friendly observers of Malaysia.

The man who organised the letter, Melbourne Labor MP Michael Danby, says supporters of the incumbent government are manipulating the legal system to drive Malaysia's best known leader out of national politics.

Barry Wain is writer-in-residence at Singapore's Institute of Southeast Asian Studies and he says the Anwar trial and much else that's wrong with Malaysia, can be traced back to Dr Mahathir Mohamad's long rule as prime minister.

He's just published a book called Malaysian Maverick: Mahathir Mohamad in Turbulent Times.

I asked him to explain the Anwar case.

BARRY WAIN: At many levels it's inexplicable because the court case is underway one doesn't want to go into all the details of it. It's sufficient to say that right from the beginning when he was accused of sodomy the second time around 18 months ago, the public opinion polls showed that almost nobody in Malaysia believed the charges, the international community does not believe the charges…

MARK COLVIN: It's widely regarded as an entirely political trial.

BARRY WAIN: It is absolutely regarded as a political trial.

MARK COLVIN: The first one was pretty clearly demonstrated as such when the inspector general of police was proved guilty of having beaten him up so badly.

BARRY WAIN: And there were other factors as well; the special branch was found to have sort of kidnapped and intimidated and tortured witnesses who were then required to testify against Anwar.

MARK COLVIN: How does it come to this though? Your book is about Dr Mahathir and you seem to really reach the conclusion that he completely broke down the separation between the state, the government and the judiciary.

BARRY WAIN: The broad area that he did most damage was in institutions; he really cut the institutions adrift in Malaysia. The institutions, as inherited from the British, generally worked. The judiciary was independent, it was fairly conservative but it worked and the police force was okay. And other elements in the bureaucracy worked.

But after 50 years of the party being in power for 50 years, a half a century, the bureaucracy and the heads of those bureaucratic institutions have become extensions of the ruling party.

And Dr Mahathir himself definitely interfered with the judiciary. He sought to subjugate the judiciary to get the political outcome he wanted and that opened a way for monetary corruption into the judiciary.

MARK COLVIN: You said at the beginning that he'd achieved some very big things and some of those are fairly obvious; there are big buildings and bridges and things that you can see; but you also say in your book that essentially he lost Malaysia a very great deal of money. How was that?

BARRY WAIN: I devoted an entire chapter to financial scandals and I excluded from that chapter just some massive projects; for instance he built a new administrative capital for Malaysia called Putrajaya and the initial price for that was something like 20 billion ringgit; it's a lot of money. If you go there and visit it now it's often looks like a bit of a ghost town.

So, ultimately whether that will be successful or not is not clear at this stage and Malaysians may have mixed feelings. I excluded those things, I even excluded his desire to build a national car; the proton, because it wasn't a financial scandal or a scam as such, it was simply it might have been misplaced but...

I just took four financial scandals and my estimate was that 50 million ringgit probably in direct losses in those. There was an attempt to rig the international tin market…

MARK COLVIN: What's that mean in say dollars?

BARRY WAIN: Well, that would have been $US20 billion at the exchange rate at the time and I think you can double that with the losses that you get through opportunity costs and other things other than the direct amounts.

MARK COLVIN: Is that known in Malaysia?

BARRY WAIN: Actually, it is known to the older generation among the politicians particularly, but it wasn't widely publicised at the time. Most of these financial scandals go back to the '80s, some of them in the early '80s; so half the population either wasn't born or was in primary school.

MARK COLVIN: So it doesn't come into play in elections for instance?

BARRY WAIN: It figured in some of the elections back there in the mid '80s and it figured in the split that took place in UMNO in 1987 when Tengku Razaleigh Hamzah the former finance minister challenged Dr Mahathir and almost defeated him.

That was the main accusation that Dr Mahathir had taken the ruling party into business and been involved in some of these scams such as trying to rig the international tin price.

MARK COLVIN: But for those not familiar with Malaysian politics it might seem puzzling as to why UMNO keeps on being re-elected given the failings that you have outlined.

BARRY WAIN: Yes and that sometimes is difficult to explain. One has to understand that political mobilisation in Malaysia takes place on racial lines, on ethnic lines, everything is on ethnic lines. Almost every party represents and ethnic group.

Constitutionally and in practice the Malays will run the country and UMNO, which is restricted of course to Malays, to a membership of Malays has always been the party of the Malays and so when it feels threatened, as it does now, it tends to play on those elements of Malay-ness and that includes Islam which is an essential element of Malay identity to rally people to the UMNO cause.

And sometimes this just plays on anxieties, plays on fears until people worry about what might happen if the Opposition, which is often portrayed in the past as predominantly Chinese, gets into power.

MARK COLVIN: It's a dangerous game?

BARRY WAIN: It's a very, very dangerous game and it's already led to extremism and again Anwar's trial can be seen as extreme. One would have hoped that Prime Minister Najib Razak, coming into power less than a year ago, might have moved to make sure that trial didn't take place.

If he was trying to, as he says he is, operating under a slogan of 'one Malaysia' and trying to bring about ethnic harmony.

MARK COLVIN: But does it mean then that Mahathir, like somebody like Lee Kuan Yu in Singapore or like President Putin in Russia is still around as a power?

BARRY WAIN: Well he's around. I don't think he has a lot of power. He has a blog site and it's a very popular one and he writes regularly on politics and buys into politics. He did help get rid of his successor, Abdullah Badawi, he turned on him very viciously.

So Dr Mahathir is there, he is a force, he's still got a fairly strongly following in the country but he doesn't by any means call the shots.

GST ..Cukai Barang dan Perkhidmatan akan dilaksanakan oleh Kerajaan Barisan Nasional dalam tempoh 2 tahun lagi. Pimpinan UMNO kata : "GST tidak bebankan rakyat". Jawapnya mudah, mana ada cukai yang tak bebankan rakyat , yang rakyat nak kalau boleh , takde cukai langsung. Baru-baru ini diadakan satu Persidangan Meja Bulat GST di Shah Alam anjuran Lajnah Pengguna dan Alam Sekitar antara lain bertujuan untuk bagi mendapatkan pandangan semua pihak agar perlaksanaan GST sama sekali tidak akan bebankan rakyat. Perkara paling asas dalam perlaksanaan GST ini kata kerajaan adalah untuk mendapatkan aliran tunai bagi kerajaan dan supaya subsidi kerajaan dalam banyak barangan seperti petrol, gula , roti putih dan minyak masak boleh ditarik balik. Kebanyakannya sudah banyakpun yang di tarik balik. Malangnya bagi rakyat Malaysia kerana Bank Dunia pernah mengisytiharkan Malaysia antara negara terkaya di didunia terutama dari segi hasil mahsul negara kita.

UMNO dan BN dengan bantuan media arus perdana akan terus berusaha melemahkan Pakatan Rakyat. Kita sebagai rakyat yang bijak dan sudah "masak" dengan sepak-terajang musuh ini jangan sekali-kali terpedaya kepada tipu-muslihat mereka. Sesuatu yang tak masuk akal jika media elektronik boleh jemput pimpinan PR dalam siaran mereka tanpa sesuatu agenda yang jahat. Takkan itupun MP Kulim tak boleh nak baca. Hari ini UMNO boleh berpeluk tubuh apabila yang hentam PR hari ini bukan orang lain tapi pemimpin PR sendiri. Bagi saya, pedulikan itu semua, tumpuan kita adalah untuk menunaikan amanah sebagai pimpinan dan wakil rakyat. Tanggungjawab yang banyak membuatkan saya rasakan masa yang ada tidak mencukupi. Pagi tadi , sempat singgah sebentar ke TADIKA Ladang Kombok , Sg Gadut di mana anak-anak pekerja estet seramai 20 orang berumur 4 hingga 6 tahun menerima pendidikan awal mereka. Pihak Pusat Khidmat DUN Paroi telah menyerahkan bantuan keperluan sekolah seperti beg sekolah , buku dan alatulis untuk membantu keluarga pekerja-pekerja estet yang rata-rata pendapatan bulanan mereka di bawah paras kemiskinan (RM720 sebulan). Sebahagian dari sumbangan tersebut adalah barangan terpakai yang masih baik dari penduduk-penduduk taman sekitar. Terima kasih kepada semua pihak yang menyumbang dan terlibat dalam program ini.

Probe cops in shooting case for attempted murder






A 30-year-old single mother who sustained five gunshot wounds when policemen opened fire on a car that she was travelling in wants those involved to be investigated for attempted murder.

Pending investigations, Norizan Salleh said the police personnel should also be suspended.

NONEAccompanied by some 30 representatives from various political parties and civil society groups, Norizan submitted a memorandum, addressed to Inspector-General of Police Musa Hassan, to a public relations officer at the Bukit Aman federal police headquarters in Kuala Lumpur this morning.

The four-page memorandum was inked by PKR, DAP, Human Rights Party, Lawyers for Liberty, Civil Liberties Malaysia, Police Watch Malaysia and the Group of Concerned Citizens.

Expressing concern over the rising incidents of 'unjustified police shootings', the groups made eight demands.

These include the immediate arrest of the policemen involved in the shooting and for Musa to explain to the public why this 'shocking' case was kept under wraps.

The memorandum also underscored the importance of establishing the Independent Police Complaints and Misconduct Commission (IPCMC).

'Cop kicked me when I cried for help'

Norizan, who was hit in the chest and wrist, also alleged that the policemen had pulled her out of the car and assaulted her, resulting in a broken rib.

Recounting the ordeal, the single mother said: "An officer kicked me when I cried for help... I felt like I was in a movie."

NONEHer parents, who were present, were reduced to tears when their daughter revealed how she had cheated death.

Norizan, who is said to have suffered permanent damage to her hand as a result of her injuries, also had a bullet lodged close to her heart removed by surgery.

The shooting occurred along the Middle Ring Road (MRR II) in Kuala Lumpur in the wee hours of the morning.

Speaking to reporters later, Norizan's lawyer N Surendran said his client got a lift home to Segambut from a friend, who was traveling with two other people, whom she did not know.

The other three, who have since been arrested, had escaped unscathed. Following investigations, Norizan was cleared of any wrongdoing.

"Police cannot discharge a firearm unless there is a threat to the enforcing officer," Surendran said, adding that the passengers were unarmed.

"Kuala Lumpur police chief Mohd Sabtu Osman's declaration of the policemen's innocence without investigation is an insult to the victim," he added.

Surendran also claimed that one those arrested was hung upside down by the police and had chilli spread all over his body in an attempt to get him to confess to armed robbery.

'They tried to mow down our men'

Defending his men's actions, Kuala Lumpur CID chief Ku Chin Wah said policemen on patrol came across the car that was being driven in a suspicious manner.

"Police ordered the car to stop but the suspects accelerated away in the direction of Selayang and onwards to Gombak.

"Police had to fire shots in the direction of the car when the suspects tried to mow down our men," he was quoted as saying by Bernama.

However, Norizan, who was in the backseat, claimed that she did not see the policemen trying to stop the car but only caught a glimpse of them aiming their guns at the car.

The police have classified the case as an accident and have refused to pay for Norizan's medical expenses, amounting to RM18,000.

Norizan is also planning to sue the police for damages.

'From the horse's mouth'

Meanwhile, PKR parliamentarian Zuraida Kamaruddin, who was one of those present, issued an ultimatum to federal CID director Mohd Bakri Zinin.

NONE"He must issue a statement (on the investigation) within 24 hours...If not, PKR will mobilise a more serious protest," she stressed.

Zuraida also said she will raise this matter with the Women, Family and Community Development Ministry.

According to the Ampang MP, Norizan's case was first brought to the attention of the MCA complaints bureau but no action was taken, following which it was brought to PKR.

"They practice a 'you scratch my back, I scratch yours' policy and wanted to close the case," she charged.

Also calling for a thorough investigation was DAP Teluk Intan MP M Manogaran.

"Today, we get it from the horse's mouth," he said, adding that other police shooting victims in the past had succumbed to their injuries before telling their tale.

He also vowed to raise the matter in Parliament when it reconvenes on March 15.

Manogaran also urged Attorney-General Abdul Gani Patail to give him and Surendran the fiat to prosecute the policemen involved for attempted murder on behalf of the people of Malaysia.

Whereas PKR Kapar MP S Manickavasagam demanded an explanation from Home Minister Hishammuddin Hussein.

AlhamduliLlah, semalam Pusat Khidmat DUN Paroi dengan kerjasama Dewan Muslimat Kawasan Rembau dan PAS Cawangan Taman Tasik Jaya telah mengadakan gotong royong 3P - Pengasingan , Pembersihan dan Perapian ke atas semua sumbangan barangan sekolah terpakai seperti baju sekolah , seluar sekolah , baju kurung sekolah , beg sekolah dan kasut sekolah. Setelah siap kerja-kerja 3P ini, semua barangan ini akan diserahkan kepada pihak yang memerlukan yang ada di dalam DUN Paroi khususnya di ladang-ladang dan rumah pangsa yang ramai orang susah.
